Terms and Conditions

The Columbus Foundation (TCF) has partnered with CharityChoice, a program of Special Kids Fund, Inc. (SKF) dba Charity Gift Certificates, to offer a Charitable Gift Card program administered by SKF through an Internet-based platform (the Website).

Donor Guidelines
Charitable Gift Card purchases are 100 percent tax deductible to the fullest extent allowed by law at the time of purchase. Purchasers will receive an e-mail confirmation verifying each purchase and acknowledging the date and amount of the donation to Special Kids Fund, Inc. dba Charity Gift Certificates (EIN# 58-2550249) for tax purposes. SKF has waived all administrative and credit card fees so 100 percent of donations go directly to the nonprofit the gift recipient selects. There is a minimal shipping and handling fee charged for physical card purchases. Physical cards ordered by credit card are shipped within one business day of purchase; expedited delivery options are available. Printable electronic cards ordered by credit card are sent to the gift recipient via e-mail immediately or on the scheduled date. Physical and printable electronic cards ordered through Donor Advised Fund grants may take up to three weeks to receive.

Recipient Guidelines
Recipients may select one organization from The Giving Store to redeem their gift card and are unable to divide this amount across multiple nonprofits.

Nonprofit Guidelines
Only organizations with a current published Directory Listing in TCF's The Giving Store are eligible for Charitable Gift Card redemption.

Personal and Noncommerical Use
The Website is for your personal and noncommercial use. As a condition of continued use of the Website, you warrant to SKF that you will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. Certain information available through the Website may relate to various laws. Such information should not be considered legal or financial advice.

Use by Persons under 13 is Restricted
In accordance with federal law and the guidelines set forth by the Federal Trade Commission regarding privacy, SKF will not knowingly collect any personal information from young people under the age of 13. The Website is restricted to users over the age of 13. Users 13 and under are welcome to visit the Website but should obtain parent or guardian consent before participating in activities.

Disclaimer of Warranties
Without limiting the foregoing, everything on the Website is provided to you as is and as available without warranty of any kind, either expressed or implied, covering the accuracy of the information contained within the website. SKF expressly disclaims all warranties about the accuracy, reliability, completeness or timeliness of the Website service, content, software text, tools, graphics, documents, and links (in electronic format or otherwise), or about results provided, including, without limitation, any implied warranties of merchantability and fitness for a particular purpose of non-infringement to be obtained from using the Website.

Privacy Policy
SKF takes the privacy of gift card purchasers and recipients seriously and does not rent or sell mailing lists to third parties. All personal information shall remain confidential unless a Website user expressly consents to such disclosure by (1) choosing to share it with the gift card recipient, (2) choosing to share it with the recipient nonprofit organization, (3) choosing to share it with TCF, (4) or agreeing to receive updates from TCF or SKF. Limitation of Liability
In no event shall SKF be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages or expenses whatsoever (including, without limitation, incidental and consequential damages, lost profits or damages resulting from lost data or business interruption) resulting from the use or inability to use the Website or the content of the Website, whether based on warranty, contract, tort, or any other legal theory, and whether or not SKF is advised of the possibility of such damages.

Indemnification
You agree to defend, indemnify and hold harmless SKF, its parents, subsidiaries, and affiliates and its respective officers, directors, employees and agents, sponsors and grantees, licensors, vendors and suppliers harmless from and against any damage, expense, claims, actions or demands, liabilities and settlements, including, without limitation, reasonable legal and accounting fees, resulting from (1) use of the Website in a manner that violates or is alleged to violate these Terms and Conditions; (2) material breach or inaccuracy of any covenant, duty, representation, or warranty of these Terms and Conditions; and (3) materials contained on the Website, including any covenant, duty, representation, or warranty of these Terms and Conditions.

Termination
You agree that SKF may terminate your use of the Website if SKF reasonably believes that you have violated or acted inconsistently with the letter or spirit of these Terms and Conditions, or violated the rights of any third party or for any reason with or without notice to you. You agree that SKF may modify or discontinue the Website, with or without notice to you. You agree that SKF will not be liable to you or any third party as a result of such modification or discontinuation.

General Provisions
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
